The petitioners seek bail in a case instituted for the offences under Sections 420, 120(B) of the Indian Penal Code and 7 of the E.C. Act.
The prosecution allegation in short is that in a raid conducted by the officials, 300 bags of rice were seized from a loaded truck.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 13.5.2019 and have got no
Patna High Court CR. MISC. No.45552 of 2019(2) dt.23-07-2019 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners have falsely been implicated in the present case. The petitioners are driver and khalasi of the truck in question. They had no knowledge regarding the goods booked by the transporter. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Sakari P.S. Case No. 73/19.
