JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offencess punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is in custody since 28.10.2016. Earlier prayer was refused on 19.04.2017 in Cr. Misc. No.11417 of 2017 for the reason that the allegation against the petitioner and others was that they dragged to the father-in-law of the informant and took him to a maize field where his murder was caused by commission of fire-arm injury. By the same order the petitioner was allowed liberty to renew the prayer for bail, if the trial is not concluded within nine months.
Patna High Court Cr.Misc. No.9059 of 2018 (3) dt.21-03-2018 P2/ The report of the learned trial Judge reveals that the case is pending for procuring attendance of all the accused persons.
Considering the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.153 of 2017, arising out of Bihariganj P.S. Case No.25 of 2016, with condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
