Petitioners apprehend arrest in a case registered for the offences punishable under Sections 498A, 504, 506/34 and other allied sections of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.

As per prosecution case, all FIR named co-accused persons along with these petitioners tortured and harassed the informant for dowry. Petitioner No. 1 is brother-in-law, petitioner No. 2 is father-in-law and petitioner No. 3 is motherin-law of the informant.

Patna High Court CR. MISC. No.59828 of 2021(4) dt.18-10-2022 2/2 Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. They are separate in mess and property. There is general and omnibus allegation of assault against the petitioners and no specific overt act has been alleged against them. It is further submitted that one co-accused Ashok Kumar, husband of the informant, has already been granted bail vide B.P. No. 417 of 2022. Petitioners have got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs.

10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Arwal in Arwal Mahila P. S. Case No. 13 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
