The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.
The petitioner and other accused persons, namely, Sheo Kumar Giri, Pappu Giri and Kameshwar Mahto are named in the FIR on suspicion. The informant alleged that he came to know that Pappu Giri called the deceased and on such the deceased went along with Pappu Giri to the house of Sheo Kumar Giri. In the next morning his dead body was found in a well. Admittedly, there is no eye witness of the occurrence. The petitioner was granted anticipatory bail till submission of charge sheet but the police did not collect any tangible evidence to show the involvement of the petitioner except
Patna High Court Cr.Misc. No.30807 of 2015 (2) dt.14-08-2015 2/2 the suspicion that the petitioner also took wine and Litti with the deceased along with other accused persons.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Chapra, Saran in Amnour P.S.
