JUSTICE RAKESH KUMAR ORAL ORDER 03-05-2018 Heard Sri Gagan Deo Yadav, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is in custody in connection with Ladaniya P.S. Case No. 173 of 2017 , registered for the offence under Sections 379, 34 of the Indian Penal Code, 1860, has prayed for grant of bail primarily on the ground that in similar situation one of the co-accused namely, Subhash Kumar has been granted bail vide order dated: 20.11.2017 vide Cr. Misc. No. 55488 of 2017. He further submits that considering the nature of accusation, the petitioner has already remained sufficiently in custody. He is in custody since 02.09.2017. Considering the nature of accusation as well as the fact that one of the co- accused has been granted bail, there is
Patna High Court Cr.Misc. No.26483 of 2018(2) dt.03-05-2018 2/2 no reason to refuse the prayer for bail to the petitioner. Accordingly, let the petitioner Bal Ram Mandal be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned learned A.C.J.M. IV, Madhubani / concerned court in connection with Ladaniya P.S. Case No. 173 of 2017 .
