The petitioners, Md. Taiyab and Md. Mohammad, seek bail in a case under Section 379, 366-A and other sections of the Indian Penal Code.

The informant named the petitioners along with other accused persons and alleged that they all kidnapped his niece. The victim was recovered and she disclosed in her statement recorded under Section 164 of the Code of Criminal Procedure that Shamshad, Irshad, Ansa along with other accused persons kidnapped her and took her to Kashmir but she did not disclose the names of other accused persons including the petitioner. The petitioners are in jail since 14.04.2015 but they have not been put on T.I.P.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.30823 of 2015 (2) dt.14-08-2015 2/2 petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura in Madhepura P.S.
