Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The sister of the informant was married in the year 2004 with co-accused Krishna Prasad, the son of this petitioner. The informant got information that Krishna Prasad has committed murder of the victim.
Submission of the learned counsel for the petitioner is that though the petitioner is separate from his son Krishna and others. However, general and omnibus allegation is there. Even the daughter of the victim, who was present in house has alleged against her father of commission of murder and subsequently stated that the
Patna High Court Cr.Misc. No.10632 of 2018 (3) dt.09-04-2018 petitioner was also involved. The postmortem report would also reveal that all the three injuries were found at the face and head of the victim which is alleged against the husband. Petitioner is in custody since 19.12.2017. Investigation of the case is already complete and the petitioner is ready to cooperate with the trial.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Deepnagar Police Station Case No.363 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
