2. The petitioner who apprehends arrest in connection with Tarabari P.S. Case No. 34 of 2026 lodged on 04/03/2026, for the offences punishable under sections 126(2), 115(2), 110, 74, 303(2), 352, 351(2) & (3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution, the FIR has been lodged against seven named accused persons including the present petitioner. It is alleged that all the accused persons including the petitioner armed with dabiyas, axes, iron rods, sticks, came and began abusing the informant and assaulted him. It is specifically alleged that the petitioner assaulted informant's daughter with dabiya on her head and informant's son with iron rod.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.47815 of 2026(2) dt.22-07-2026 2/2 that the petitioner is innocent and has been falsely implicated in the present case. There is a case and counter-case between the parties. The antecedent of the petitioner is clean.

5. Learned APP for the State vehemently opposes the prayer for bail.

6. Considering the specific allegation of assault against the petitioner, this Court is not inclined to grant the bail to the petitioner.

7. Accordingly, the prayer for bail of the petitioner in connection with Tarabari P.S. Case No. 34 of 2026, pending before the learned J.M.-1st Class, Araria, is hereby rejected.

8. However, if the petitioner surrenders before the Trial Court within four weeks from today, the Trial Court is expected to pass an order on his surrender-cum-bail application on the same day, without being prejudiced by the fact that the petitioner's anticipatory bail has been rejected by this Court.
