The petitioners apprehend their arrest in Complaint Case No.15C of 2017 registered under Sections 323, 384, 506 of the Indian Penal Code.
The complainant named the petitioners and alleged that on 03.01.2017, all the accused persons came and on the order of Bibi Gul Sanober, petitioner No.1, all the accused persons assaulted the complainant and others and also forcibly took thumb impression on plain papers. They also snatched money. The learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.5224 of 2018 (2) dt.02-02-2018 complainant, Md. Saifullah is own brother of petitioner Nos.2, 3 and 4. Petitioner No.1 is the wife of petitioner No.2. On account of some land dispute, own brother of petitioner No.2 to 4 has filed this complaint petition making false and frivolous allegation and this fact is apparent from the fact itself that the occurrence is said to have taken place on 03.01.2017 but the complaint petition was filed on 13.01.2017.
Considering the facts aforesaid, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Complaint Case No.15C of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
