2. The present writ petition has been filed for a direction to the respondents to produce the OMR sheet of main written examination of the petitioner and master answer key of main written examination of advertisement No.2/23, published

Patna High Court CWJC No.10966 of 2024(2) dt.25-07-2024 2/3 by B.P.S.C. to ascertain the merit in the written examination. The further prayer is to allow the petitioner to appear in physical efficiency test for the post of Sub-Inspector of Police as per advertisement No.2/2023, if the marks of petitioner in main written examination is more than candidates, who were called for physical efficiency test.

Learned counsel for the petitioner submits that by virtue of demanding his OMR sheet of the main examination, the petitioner has moved before the RTI authority and subsequently in first appeal under the R.T.I. Act. But the Bihar Police Sub-Ordinate Service Commission has not provided the OMR sheet and only informed that after publication of the result OMR sheet can be available.

4. Learned counsel for the Bihar Police Sub-Ordinate Service Commission submits that the result of Advertisement No.2 of 2023 has been published on 09.07.2024 and now if petitioner demands OMR sheet afresh through R.T.I., which shall be made available to him.

5. In this view of the matter, learned counsel for the petitioner seeks permission to withdraw this application to file a fresh R.T.I. before the Commission.

6. Permission is granted.
