ANJANA MISHRA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is a retired Branch Manager of United Bank of India, Katihar Branch and is apprehending his arrest in connection with Katihar Town Sahayak P.S. Case No.442 of 2012 for allegedly having committed the offence under Sections 420, 467 and 468 of the Indian Penal Code. Case diary, in the present case, had been called for, which has since been received.

Learned counsel for the petitioner submits that except for the fact that the petitioner was the Branch Manager at the relevant point of time, there is no further cogent material on the record so as to connect the petitioner with the occurrence for

Patna High Court Cr.Misc. No.29532 of 2015 (3) dt.07-10-2015 2/2 withdrawal of Rs.3,86,000/- by one Jafar Ali. It is further submitted that neither the petitioner was the passing officer nor was he responsible for verification of the signature. Considering the aforementioned facts and circumstances and also that there is no further material in the case diary, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Katihar Town P.S. Case No.442 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
