In this case, the petitioner is apprehending his arrest in connection with Kahalgaon (Ghogha) P.S. Case No. 344 of 2019 registered for offences under sections 307 of the Indian Penal Code and Section 27 of the Arms Act. As per prosecution case, on 7.6.2019 at 8 AM, the Informant had gone to worship at Dana Baba Asthan, when he was returning to his home, one Praveen Yadav was fixing Nad and picket on his land and was tying up his cow, when he objected for the same, he took out pistol and fired upon him but, had a narrow escape. He again tried to repeat fire but, the villagers gathered there and his life was saved. Learned counsel for the petitioner submits that no

Patna High Court CR. MISC. No.49147 of 2019(2) dt.06-08-2019 2/2 such incident as alleged has taken place rather to implicate the petitioner, the present allegation has been made. He further submits that the Informant has got no injury in the alleged incident.

Looking to the entire facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 344 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
