2. The petitioner seeks bail in connection with Digha P.S. Case No. 239 of 2025 dated 11.04.2025, instituted for the offence punishable under Section 64 of the B.N.S., 2023.

3. The allegation against the petitioner is that on the pretext of false assurance of marriage, he entered into physical relationship with the informant (victim).

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that as per the prosecution, the petitioner established physical relationship with the informant on the false promise of marriage but the fact is that petitioner is

It is next submitted that petitioner and informant work at the same place and if the petitioner established physical relationship with the informant, it was a consensual relationship. Lastly, it has been submitted that the petitioner is in custody since 12.04.2025, he has no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- IX, Patna in Digha P.S.
