JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 27.7.2017 passed in Cr.Misc.No. 34513 of 2017 with direction to learned trial court to conclude the trial within a period of six months.

Submission of learned counsel for the petitioner is that charge has been framed in this case but trial has not commenced till date and petitioner is in custody since 26.10.2016. Heard learned APP and perused the report, from which it appears that learned trial court has sought three months further time to conclude the trial.

Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to conclude the

Patna High Court Cr.Misc. No.6770 of 2018 (3) dt.28-02-2018 2/2 trial within a further period of three months from the receipt of this order. If trial is not concluded within the said period, petitioner shall be released on bail by the court below itself to its own satisfaction.

With the above observation, this application is disposed of.
