2. The petitioner apprehends his arrest in a case registered for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act.
3. Learned counsel for the petitioner submits that petitioner has been made accused in this case on the basis of confessional statement of co-accused persons, who were apprehended on spot. No incriminating article has been recovered from the possession of this petitioner. Petitioner is neither owner nor driver of the alleged seized vehicle, as stated in paragraph - 7 of the supplementary affidavit. Petitioner has got clean antecedent.
4. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Court-II, Muzaffarpur in connection with Kanti P.S. Case No. 268 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
