2. The petitioner has prayed for bail registered for the offence punishable under Sections 316(2), 318(4), 338,, 336(3), 340(2) and 61(2) of the B.N.S., 2023.
3. The case of the prosecution, in short, is that the petitioner, who is an agent of Bhojpur Jadid PACS (Cooperative Bank), along with officials of the said bank, has taken deposits of Rs. 2 crore from the persons who have put their signature on the FIR. As they went to the branch, they found that the branch was closed.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.48069 of 2026(2) dt.23-07-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He further submits that from perusal of the FIR, it is clear that the petitioner is merely an agent of the said bank. The Branch Manager, Seraj Quraishi, and Meraz Khan, who is the PACS President, have already been granted anticipatory bail by the learned coordinate Bench of this Court vide Cr. Misc. Nos. 33121 of 2026 and 37501 of 2026, respectively. Learned counsel submits that the allegations leveled against the petitioner are baseless. The petitioner is merely an agent, and the main thrust of allegations are against the Branch Manager and other officials, who have already been granted anticipatory bail. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 21.04.2026.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
