JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-04-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. The petitioner seeks bail in connection with Katoria P.S. Case No.230 of 2019 registered for the offence punishable under Sections 448, 454, 302/34 of the Indian Penal Code. As per the prosecution case, while the son of the informant was sleeping, the accused persons who happens to be relative of the informant, came armed with kulhari, danda and started abusing the informant. On objection raised by the informant, they hit the son of the informant on the eye due to which he fell down and died on the spot.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics and has not committed any offence as alleged in

Patna High Court CR. MISC. No.2330 of 2021(3) dt.09-04-2021 2/2 the FIR. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Specific allegation of assault is against the co-accused Bharat Roy. Similarly situated co-accused persons namely Binod Rai, Ranjeet Rai and Horla Rai @ Horila Rai have been granted anticipatory bail vide order dated 09.10.2020 passed in Cr. Misc. No.12297 of 2020 by a co-ordinate Bench of this Court. The petitioner has no criminal antecedent and has been languishing in custody since 24.04.2020.

Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below, where the case is pending in connection with Katoria P.S. Case No.230 of 2019.
