In this case, the petitioner is seeking anticipatory bail in connection with Thakurganj P.S. Case No.43 of 2019, registered for the offence punishable under Sections 341, 323, 354, 307 and 498 (A) of the Indian Penal Code. Allegation against the co-accused including the petitioner is to have assaulted the informant with lathi, danda and the petitioner attempted to commit murder of the informant by pressing her neck with hands, however, counsel for the petitioner submits that the petitioner is the stepson of the informant and he has falsely been implicated in the present case
Patna High Court CR. MISC. No.47529 of 2019(2) dt.31-07-2019 2/2 as the informant is in habit of levelling such baseless allegations. There is also inordinate delay in lodging the present case.
Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in connection with Thakurganj P.S. Case No.43 of 2019 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
