The petitioner is in custody since 27.10.2015 in connection with a case registered for the offences punishable under Sections 341/332/333/353/307/34 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that though the petitioner's name was not taken at the time of lodging of the First Information Report, subsequently, on the basis of suspicion, the petitioner was taken into custody and put on Test Identification Parade. It is stated that he was recognized thereat. He further submits that there was malafide intention in the recognition of the petitioner by the Police at the Test Identification Parade. Considering the period of custody and that the petitioner's name surfaced only on the basis of suspicion, let the petitioner
