JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-06-2021 Heard Mr. Biresh Kumar Sinha, learned counsel for the petitioner and Mr. Akshay Lal Pandit, Additional Public Prosecutor for the State through video conferencing.
2. Petitioner seeks regular bail in connection with Patna Junction (Rail) PS Case No. 01/2020 registered for the offence punishable under Sections 302, 201/34 of the IPC.
3. The allegation, as per First Information Report, is that brother of the informant had gone to see his lover Ukha Kumari in the village, Jethuli where his dead body was found near the railway track having marks of injury on his neck and other parts of the body. The informant has further alleged that the petitioner along with other accused persons who are family members of Ukha Kumari have killed his brother and thrown the dead body near the railway track.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.3955 of 2021(4) dt.24-06-2021 2/3 petitioner is father-in-law of the said girl, Ukha Kumari and has been implicated in this case merely on the basis of suspicion. Learned counsel further submits that Ukha Kumari as well as other accused persons, namely, Sindhu Rai @ Sindhu Ray and Fekan Rai @ Ashok Rai have been granted bail by coordinate Benches of this Court vide Cr. Misc. No. 20076/2020 and 25347/2020 respectively.
5. Learned counsel next submits that petitioner is in custody since 08.06.2020 and the charge-sheet has already been submitted in the matter.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated accused persons have been granted bail by coordinate Benches of this Court and the petitioner is in custody since 08.06.2020 and the charge-sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner.
7. Accordingly, let the petitioner, CHHATRI RAI be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with Patna Junction (Rail) PS Case No. 01/2020.
