The present application seeks modification of order dated 04.12.2014 passed in Cr. Misc. No. 30051 of 2014.
Learned counsel for the petitioner submits that while granting bail to the petitioner on 04.12.2014, the condition was that one of the bailors shall be the father of the petitioner. It is submitted that the father of the petitioner is not in a fit mental state and thus would not be able to stand bailor of the petitioner. It is prayed that the order be modified and in place of the father of the petitioner any close relative may be directed to be the bailor.
Considering the facts and circumstances of the case and submissions of learned counsel for the parties, the
Patna High Court Cr.Misc. No.29996 of 2015 (2) dt.29-07-2015 2/2 order dated 04.12.2014 passed in Cr. Misc. No. 30051 of 2014 stands modified to the extent that one of the bailors shall be the own paternal uncle of the petitioner. He shall file an affidavit before the Court below showing the genealogy and how he is related to the petitioner.
The other terms and conditions of the order dated 04.12.2014 passed in Cr. Misc. No. 30051 of 2014 shall remain unchanged.
The application stands disposed off in the aforementioned terms.
