The petitioner seeks bail in connection with Motipur P. S. Case No. 62 of 2016 registered for the offence punishable under Section 47(a) of the Excise Act. It has been contended by the learned counsel for the petitioner that the recovery was not made from the conscious possession of the petitioner. He has been falsely implicated in the present case and only after the accused who was carrying 40 litres of illicit liquor on motorcycle managed to escape. It is also contended that prior to the present case, the petitioner has not been made accused in any other case and the F.I.R. was instituted
Patna High Court Cr.Misc. No.24810 of 2016 (2) dt.06-06-2016 2/2 prior to the amendments made under the Bihar Excise Act, 1915. Regard being had to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate West, Muzaffarpur in connection with Motipur P.
