JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and is languishing in jail custody since 13.04.2015. Originally, the informant filed complaint case on 01.04.2014 and the aforesaid complaint case was converted into police case on 21.05.2014.

It is admitted case of the informant that he came to know about the death of deceased on 28.03.2014 but even then he did not lodge the aforesaid case on the date when he came to know about the death of the deceased. Moreover, it is informed on behalf of the petitioner that deceased died of her ailment and when the informant came to know about the real fact, he filed

Patna High Court Cr.Misc. No.30294 of 2015 (3) dt.29-10-2015 2/2 compromise petition mentioning this fact that deceased died of jaundice.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 33 of 2014.
