2. The petitioners are apprehending their arrest in connection with Amarpur P.S. Case No. 471 of 2020 dated 14.08.2020 registered for the offence punishable under Sections 341, 323, 307, 354, 504, 506/34 of the Indian Penal Code.
3. In this case, the accusation against the accused persons including the petitioners is of assaulting the Informant by means of lathi and iron rod causing injury over his head.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the
Patna High Court CR. MISC. No. 48039 of 2026(2) dt.22-07-2026 2/3 present case. Counsel for the petitioners, by referring to the allegation made in the F.I.R., submits that there is nothing specific against the petitioners rather the allegation of causing injury is against the co-accused Suman Kumar Singh and Simple Kumar Singh and the injuries have been found to be simple in nature. It is further submitted that the aforesaid co-accused Suman Kumar Singh and Simple Kumar Singh have already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court vide order dated 07.05.2026 passed in Cr. Misc. No. 32176 of 2026. It is lastly submitted that the petitioners bear no criminal antecedent.
5. On the other hand, the learned APP for the State has opposed the prayer for bail of the petitioners.

Having heard learned counsel for the parties and considering the fact that there is nothing specific against the petitioners, the co-accused against whom there is allegation of assault have already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, the petitioners having no criminal antecedent and, as also, the fact that the injuries have been found to be simple in nature, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/-
Patna High Court CR. MISC. No. 48039 of 2026(2) dt.22-07-2026 3/3 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 471 of 2020, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. as well as the following conditions: (i) One of the bailors should be the family member/relative/known of the petitioner(s) who shall provide official document / personal affidavit to show his/her bona fide; (ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself;
(iii) the petitioner(s) shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner(s) shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Ajit Kumar, J) rishi/- U T
