Petitioner, already in custody, seeks bail in connection with Jamui (Adarsh Thana) P.S. Case No.328 of 2017, registered under Sections 148, 149, 379, 436, 447 and 452 of the Indian Penal Code.

Allegation in brief is that 100-150 unknown persons ransacked the shop of the informant, they did arson and looted articles kept in the shop.

Learned counsel for the petitioner submits that during communal flare this occurrence was committed by unknown miscreants, there is no recovery of looted articles from possession of the petitioner, there is no material except disclosure of his participation stated by one co-accused Uday

Patna High Court Cr.Misc. No.8369 of 2018(2) dt.12-02-2018 2/2 Kumar Singh and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, petitioner Karu Mistry is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Jamui (Adarsh Thana) P.S. Case No.328 of 2017.
