JUSTICE ANIL KUMAR SINHA ORAL ORDER 05-08-2019 The petitioner apprehends his arrest in connection with Manjhi P.S.Case No. 139 of 2019 registered under Sections 307, 323,324,341 and 504/34 of the Indian Penal Code. Allegation against the petitioner is that petitioner along with other accused persons assaulted the brother of the informant Ranjeet Pandey with iron rod on his head and also snatched the golden chain of the informant.
Learned counsel for the petitioner submits that there is case and counter case in between the parties inasmuch as petitioner has also lodged Manjhi P.S.Case No. 138 of 2019 for the same incident. Learned counsel further submits that from perusal of injury report, which is Annexure-2, it would be evident that injury caused to Ranjeet Pandey is simple in nature by hard blunt substance

No.48392 of 2019(2) dt.05-08-2019 2/2 After having heard learned counsel for the parties and taking into consideration the fact that there is case and counter case in between the parties and injury caused to the brother of the informant is simple in nature as such I am inclined to grant anticipatory bail to the petitioner. Let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Saran at Chapra in connection with Manjhi P.S.Case No. 139 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
