The petitioner seeks regular bail in connection with Patliputra P.S. Case No. 33 of 2018 for the offences punishable under Section(s) 379, 414 and 411 of Indian Penal Code. The allegation is regarding recovery of motorcycle said to be standing at the shop of the petitioner upon the confessional statement made by one co-accused person, namely, Kanhaiya Kumar.
The learned counsel for the petitioner submits that the petitioner is having a clean antecedent and in fact said motorcycle was standing in front of shop of the petitioner, hence the allegation levelled against the petitioner is baseless. It is further submitted that the petitioner has a clean antecedent and is languishing in
Patna High Court Cr.Misc. No.31770 of 2018 (2) dt.31-05-2018 2/2 custody since 31.01.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-XII A.C.J.M, Patna in connection with Patliputra P.S. Case No. 33 of 2018.
