JUSTICE ARUN KUMAR ORAL ORDER 16-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Chakia P.S.Case No. 301 of 2017 registered under Sections 379 and 420/34 of Indian penal Code.

Allegation in brief is that 04 days prior to lodging of FIR, the informant had gone to withdraw money from ATM on 09.11.2017 and 03 unknown persons cheated him and withdrew Rs. 24,000/- from his ATM card and when he again went to withdraw money on 13.11.2017, he found the said three persons who had earlier cheated, standing there and on alarm raised, they were apprehended by the police and some cash was recovered from their possession.

Submission is that after four days of the alleged occurrence, present case was instituted and money recovered from the

Having considered the aforesaid facts and circumstances, the petitioner, namely , Keshav Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM13, Motihari, East Champaran in connection with Chakia P.S. Case No. 301 of 2017.
