2. The petitioner is apprehending arrest in connection with Amarpur P.S. Case No. 471 of 2020, lodged on 14.08.2020, for the offence punishable under Sections 341, 323, 307, 354, 504, 506/34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against nine named accused persons including the present petitioner with allegation that they all reached at the shop of the informant and assaulted the informant by iron rod and lathi on his head, due to which, he sustained injury.
4. Learned counsel for the petitioner submit that the
Patna High Court CR. MISC. No.47767 of 2026(2) dt.22-07-2026 2/3 petitioner is innocent and has committed no offence. Counsel submits that the present FIR has been lodged on 14.08.2020, whereas the dispute has arisen also arisen on 13.08.2020. He submits that both the parties are resident of the same locality and they are well known to each other. He submits that due to intervention of the well wishers, the parties have filed compromise petition that grievance has been settled and they are not ready to contest against each other. In this regard, they have filed application before the C.J.M., Banka. He further submits that the petitioner has clean antecedent and there are case and counter case from both the sides.
5. Learned APP for the State opposes the prayer for bail of the petitioner but submits that due to intervention of the well wishers, parties are not ready to contest against each other.
6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of C.J.M., Banka, in connection with Amarpur
Patna High Court CR. MISC. No.47767 of 2026(2) dt.22-07-2026 3/3 P.S. Case No. 471 of 2020, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.
