JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 26-09-2024 Both the applications arise out of the same case i.e. Khaira P.S. Case No. 205 of 2024 and accordingly, both the cases are being disposed of by this common order.
2. Heard learned counsel for the petitioners and learned APP for the State.
3. The petitioners seek bail in connection with Khaira
Patna High Court CR. MISC. No.52345 of 2024(3) dt.26-09-2024 2/3 P.S. Case No. 205 of 2024 registered for the offence punishable under Sections-341, 342, 323, 325, 307, 333, 353, 504, 506, 34 of the Indian Penal Code.
4. As per prosecution case, while the informant who is Block Panchayat Raj Officer was going to the village of the petitioners, they stopped his vehicle and badly assaulted the informant and his driver with an intention to kill. It has also been mentioned in the FIR that mother of the petitioner, Rishi Raj @ Dablu @ Rishi Kumar is Mukhiya of the village and she had withdrawn Rs. 31,00,000/- (Thirty one lakhs). She was directed by the informant to produce the documents regarding expenses of those 31 lakhs but she was not providing the documents and it was the reason, the occurrence took place.
4. Learned counsel for the petitioners has submitted that they are innocent and they have falsely been implicated in this case. All the injuries are simple in nature except one injury which is grievous in nature.
5. On the otherhand, learned counsel for the informant has opposed the prayer for bail by submitting that the petitioners made hindrance in discharge of official duty of the informant and badly assaulted him. A number of cases are pending against them.

6. It appears that the informant requisitioned the documents relating to expenses of the government money withdrawn by mother (Mukhiya) of the petitioner, Rishi Raj @ Dablu @ Rishi Kumar. The petitioners badly assaulted the informant and his driver. One of the injuries is grievous in nature.
7. Learned APP has opposed the prayer for bail.
8. Considering the aforesaid facts and circumstances, the petitioners does not deserve the privilege of bail and accordingly, the same is rejected.
9. However, the learned court below is directed to expedite the trial.
