The petitioner seeks bail in a case under Section 302/34 of the Indian Penal Code.

The petitioner was granted bail on 23.11.2012 vide order passed in Cr. Misc. No. 41349 of 2012. The bail bond of petitioner was cancelled on 14.12.2013. The petitioner is in jail since 05.01.2015. The petitioner has already remained in jail for more than seven months.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Patna in Sessions Trial No. 909 of 2012 arising out of

Patna High Court Cr.Misc. No.33288 of 2015 (2) dt.19-08-2015 2/2 Budha Colony P.S. Case No. 74 of 2011 subject to the condition that petitioner shall be physically present on each and every date before the court below during the course of trial failing which the learned trial court shall be at liberty to cancel the bail bond of the petitioner.
