Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 325, 307, 379, 504, 506 of the Indian Penal Code.

It is alleged in the F.I.R that this petitioner

Patna High Court CR. MISC. No.4589 of 2021(3) dt.26-10-2021 2/3 along with other co-accused persons assaulted the informant. The petitioner is also alleged to have assaulted the informant with bricks and broke his teeth. When the wife and son of the informant came to his rescue, they were also assaulted. The accused persons snatched mangalsutra of the wife of the informant and also broke the car of the informant.

It is submitted by learned counsel for the petitioner that for the alleged occurrence of 03.08.2020, the F.I.R has been registered on 14.09.2020. It has further been submitted that at earlier point of time, the father of the petitioner had filed a case against the informant. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)

Patna High Court CR. MISC. No.4589 of 2021(3) dt.26-10-2021 3/3 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Hathauri P.S. Case No. 200 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
