(I) To issue an appropriate order/s, direction/s including a writ preferably in the nature of CERTIORARI for quashing the order as contained in letter No.

994/995 dated 03-10-16 whereby and

Patna High Court CWJC No.17491 of 2021(2) dt.17-02-2024 2/3 whereunder the respondent No. 7 (hereinafter referred to as District Programme Officer (I.C.D.S.), Nalanda has directed the Child Development Project Officer, Ekangarsarai (C.D.P.O.

in short) to appoint the private respondent no.11 to the post of Anganbari Sewika for Anganbari Centre Milkipar bearing Centre No. 71, Ward No. 14 situated in Ekarngar Dih Panchayat under Ekangarsarai Block within the District of Nalanda.

(II) To direct the respondents to appoint the petitioner to the post of Anganbari Sewika for Centre No. 71, Ward No. 14 Anganbari Centre Milkipar Panchayat Ekangar Dih under Ekangarsarai block within the District of Nalanda by way of placing her name first in the merit list prepared for such appointment as such the private respondents No. 11 is resident of two village panchayat and her name appears in the electoral roll of Ekangarsarai Dih Panchayat and Khusrupur Nagarpalika. Apart from the same she is employed as a teacher in Awasiya Bal Vikash Niketan situated in front of south side of Railway station of Khusrupur drawing salary more than Rs. 12,000/-.

(III) To direct the respondents to enquire into the matter of irregularity

Patna High Court CWJC No.17491 of 2021(2) dt.17-02-2024 3/3 committed in selection process for the post in question in the above mentioned Panchayat particularly that mark sheet of Madhyama Examination of the private respondent No. 11 is forged and fake one.

(IV) To direct the respondent No. 10 to verify the mark sheet of private respondent No. 11 of Madhyama Examination as to whether the same is forged and fake not."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including that of filing a suit before the Ld. Civil Court having competent jurisdiction, for redressal of the aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
