"(i) For issuance of an appropriate order, direction or writ in the nature of MANDAMUS commanding the respondents to grant/issue license for public distribution shop (PDS) to petitioner under Gram Panchayat, Baruar, Block- Laukahi, Police Station- Andhramath, Sub DivisionPhulparas, District - Madhubani (ii) For any other relief or reliefs for which petitioner may be entitled found entitled in the facts and circumstances of the case."

2. Learned counsel for the petitioner has stated that the petitioner has applied for issue of license to the PDS shop

Patna High Court CWJC No.14786 of 2019(12) dt.22-08-2023 2/3 under the Gram Panchayat, Baruar, Block Laukahi, Police Station- Andhramath, Sub Division- Phulparas, DistrictMadhubani and in the final list of candidates the petitioner was placed at second position. Further, it is stated that the person who was put in the first place has already withdrawn his candidature and, therefore, the petitioner's case has to be considered by the authorities concerned. But, till date the authorities concerned have not passed any order granting the petitioner license of the PDS shop.

3. Per contra, learned counsel appearing on behalf of the respondents has stated that direction may be given to the authorities concerned to pass orders on the application of the petitioner. If the petitioner makes a fresh representation to the authorities concerned, a direction may be given to that effect.

4. Having regard to the above submissions, the petitioner is directed to make a representation along with the copy of this order to the authorities concerned within a period of two weeks from the receipt of the copy of this order and on such representation being made the authorities concerned shall pass necessary orders on the selection of the petitioner as a PDS dealer strictly in accordance with the rules and regulations as expeditiously as possible preferably within a period of eight

5. With the above direction, the present writ petition is disposed off.
