The petitioner seeks bail in anticipation of his arrest in connection with Palanwa P.S. Case No. 13 of 2020 dated 21.01.2020 instituted for the offences under Sections 414, 420, 467 and 468 of the Indian Penal Code.

The petitioner is sought to be prosecuted in this case because of recovery of a motorcycle from near his Khatal which is said to be a stolen property. Learned counsel for the petitioner has submitted that the information given to the police regarding the involvement of the petitioner in sale and

The petitioner does not have criminal antecedents.

The recovery of the motorcycle was not from the Khatal but from the side of the Khatal. There is no report about such vehicle being a stolen property. The petitioner has been made accused in this case only on the basis of guess work of the police.

Regard being had to the facts aforestated, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul, East Champaran at Motihari in connection with Palanwa P.S. Case No. 13 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
