JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of injured was recorded on 09-04-2015 at PMCH and in the said statement, he, specifically, stated that it was the petitioner who gave sickle blow, causing injury on his neck. The injury on the neck of the injured was found dangerous to the life of the injured.
Learned counsel for petitioner submits that the petitioner was on duty at the time of alleged occurrence as he was working as Sepoy of Home Guard.
Considering the above-said facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in
Patna High Court Cr.Misc. No.30105 of 2015 (3) dt.14-10-2015 2/2 connection with Majorganj P.S. Case No. 66 of 2015 pending in the court of learned Chief Judicial Magistrate, stands rejected at least, at this stage.
However, petitioner may renew his prayer for bail after framing of the charge.
