The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) &(f), 32 and 41(1) of Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 96 litres of illicit liquor was recovered from the vehicle being driven by the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case. No incriminating article has been recovered from possession of the petitioner. He is in custody since 06.07.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner has no criminal antecedent and charge sheet having been submitted in

Patna High Court CR. MISC. No.59168 of 2021(2) dt.11-04-2022 2/2 this case, the Court directs the petitioner to be enlarged on bail in connection with Bandhua Kuraba P.S. Case no. 31 of 2021 on furnishing bail bond of Rs 10,000/ (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Banka.
