The petitioner seeks bail in a case registered for offences under Sections 399/402 I.P.C, Sections 25 (1-b)a/26 Arms Act and Section 37 (b) (c) of the Bihar Prohibition and Excise Act.

As per allegation, one pistol and 10 cartridges were recovered from the possession of the petitioner in a drunken state.

However, the petitioner submits that he was forced to sign the seizure list. Petitioner claims that he is having clean antecedent and is in custody since 27.10.2017. Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on

Patna High Court Cr.Misc. No.20382 of 2018(2) dt.19-04-2018 2/2 bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Daniawa P.S. Case No. 133 of 2017 (Spl. Case No. 7333/17) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.

However, at the time of furnishing bail bonds, the court below will verify and assure itself regarding the criminal antecedent of the petitioner. If the petitioner is having clean antecedent then his bail bonds would be accepted otherwise he would not be released on bail.
