JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the victim. The contention on behalf of the petitioner is that as a matter of fact, ten days prior to institution of the present case the victim had gone to the house of the informant from where she was found missing and after that informant lodged this false case against the petitioner and others.

It would appear from perusal of the first information report that marriage of petitioner was solemnized with victim one year ago and there is accusation that the victim was subjected to cruelty and harassment due to non-fulfilment of illegal dowry

Patna High Court Cr.Misc. No.35474 of 2015 (5) dt.23-09-2015 2/2 demand. Moreover, there is specific allegation in the first information report that having committed murder of the victim the petitioner and others got disappeared her dead body. Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Yogapatti (Sanichari) P.S. Case No. 293 of 2013 pending in the court of Chief Judicial Magistrate, West Champaran, Bettiah stands rejected, at least, at this stage. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
