1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a), 32(2) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2022 as well as Sections 8, 20(b)(ii)(c), 25 and 29 of the NDPS Act.

3. In the nature of allegation as alleged in the FIR, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner as apart from the liquor, 1.38 Kg of charas has also been alleged to have been recovered from possession of Kanha Sahani and the name of the petitioner transpired in the confessional statement of Kanha Sahani and also petitioner has antecedent of four cases.

4. Hence, the prayer for anticipatory bail of the

Patna High Court CR. MISC. No.51206 of 2024(2) dt.30-07-2024 2/2 petitioner is rejected in connection with Harsidhi P.S. Case No. 19 of 2024 pending in the Court of learned Exclusive Special Excise Court No. 1, East Champaran at Motihari/Successor Court.
