The petitioner, already in custody, seeks bail in connection with Alamnagar (Ratwara OP) P.S.Case No. 129 of 2017 registered under Section 366A/34 of the Indian penal Code.
Allegation in brief is that petitioner enticed away the minor daughter of the informant.
Submission is that statement of the recorded under Section 164 Cr.P.C. does not show that she was sexually assaulted.
Learned counsel for the State submits that she has specifically stated that this petitioner and Rajesh Ram, Dhananjay Sharma and Nitish Kumar kidnapped her and and girl is minor and bail applications of co-accused Nitish Kumar and Dhananjay Kumar have been rejected by the co-ordinate
Patna High Court Cr.Misc. No.12509 of 2018(3) dt.19-04-2018 2/2 Benches of this Court vide Cr. Misc. No. 51853 of 2017 and Cr. Misc. No. 57676 of 2017 respectively.
Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected. However, trial court is directed to expedite the trial and conclude the same preferably within a year.
