The petitioner seeks bail in connection with Galgalia P.S. Case no. 5 of 2018 registered under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act-2016.

6.750 lts. of foreign liquor is said to have been recovered from the possession of the petitioner and petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has been falsely implicated in the case at the instance of his enemy by planting the aforesaid

Patna High Court Cr.Misc. No.20412 of 2018(2) dt.11-04-2018 2/2 recovery from his possession. He has no concern with the seized liquor. He has no criminal antecedent. He has been languishing in custody since 19.01.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. II-cum-Special Judge, Excise Act, Kishanganj in connection with Galgalia P.S. Case no. 5 of 2018. (Prakash Chandra Jaiswal, J) rohit/- U T
