The petitioner seeks bail in Katihar Mufassil P.S. Case No. 7 of 2015, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code, Section 27 of the Arms Act and Sections 3(2)(v) of the SC/ST Act. The petitioner Suresh Yadav, Md. Umar Ali and Harendra Urao intercepted Jamiral Urao and his wife. The petitioner and Harendra Urao are said to have made indiscriminate firing which proved fatal to the wife of Jamiral Urao. The injured Jamiral Urao has categorically identified Suresh Yadav to be his assailant. Prayer for bail of similarly situated accused Harendra Urao has already been rejected on 30.06.2015 vide orders passed in Cr. Misc. No.17835 of 2015.
Patna High Court Cr.Misc. No.34085 of 2015 (2) dt.21-08-2015 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
