JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Buniyadganj P.S.Case No. 115 of 2012 registered under Sections 307, 324, 341/34 of the Indian penal Code and Section 27 of Arms Act.
Submission is that petitioner is not named in the FIR and allegation in the FIR is specific regarding opening fire arms against three accused persons Dharmendra Kumar Singh, Ravindra Kumar Singh and Sajjan Kumar Singh and one person Jitendra Kumar Sinha apprehended by the police four months after the occurrence in a case of stealing motorcycle, named this petitioner in confessional statement with regard to participation in the present occurrence, except that there is no other material. Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.3787 of 2018 (2) dt.19-01-2018 2/2 the petitioner, namely , Bilash Yadav @ Ram Bilash Yadav @ Bijay Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Buniyadganj P.S. Case No. 115 of 2012, with condition that one of the bailor must be his close family relative. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical emergency, his bail bond shall be liable to be cancelled.
