JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. On 08-12-2014, a dead body of an unknown person was recovered and accordingly, the present case was registered against unknown persons. In course of investigation, on 12-122014, one Ram Ekwal Singh @ Bala Singh @ Bala Das claimed to have identified the dead body of the deceased, which is evident on perusal of paragraph-39 of the case diary and thereafter, on the same day, i.e. 12-12-2014, a petition was filed by wife of the deceased before officer-in-charge of concerned Police Station disclosing this fact that on the alleged date of occurrence, petitioners and some unknown persons hired the tempo of the
Patna High Court Cr.Misc. No.33382 of 2015 (3) dt.16-10-2015 2/2 deceased and after that, the deceased was found traceless. The tempo of the deceased was recovered in abandoned condition on the same day i.e. 12-12-2014 and except the aforesaid material, there appears to be nothing against petitioners. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Patahi P.S. Case No. 126 of 2014 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana, East Champaran at Motihari.
