Petitioner being rice mill owner is in jail custody since 9.6.2015 on the accusation that he did not supply rice as per agreement executed between the parties and accordingly, misappropriated government money.

Admittedly, certificate case has already been instituted against the petitioner and even if the prosecution story assumed to be true, then also, it may be a case of breach of agreement. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Dumra P.S. Case no. 90/2015.
