JUSTICE ARUN KUMAR ORAL ORDER 21-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Ladaniya PS Case No. 135 of 2017 registered under Sections 363, 364A and 34 of the IPC.

The allegation in brief is that the informant's grand-son was kidnapped while he was coming with his sister on the pretext of showing the shop of his uncle, the boy was recovered next day from the possession of Mohan Kumar Pandey who disclosed name of the petitioner as one of the persons involved in the said occurrence. Learned Counsel for the petitioner submits that the FIR is against unknown, the boy has not named the petitioner, he was not put on TIP, the sister of the kidnapped boy has disclosed name of Mohan and Rajendra and except disclosure of name of the petitioner by Mohan Kumar Pandey there is no other material against the petitioner and he has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Devan Kumar Yadav @ Devan Kumar Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IV Madhubani in connection with Ladaniya PS Case No. 135 of 2017.
