Petitioner is not named in the first information report and it is stated in course of investigation, petitioner and two persons were seen carrying stolen motorcycle and thereafter, petitioner and one Anil Kumar Manjhi were caught by the police whereas their associate managed to escape from there.

The contention on behalf of the petitioner is that informant of the present case filed a petition before SDJM, Vaishali at Hajipur disclosing false implication of the petitioner in the present case. Para 3 of the petition reveals that the petitioner does not have any criminal antecedent and happens to be co-villager of the informant.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
