2. The petitioner is seeking regular bail in connection with Masaurhi P.S. Case No. 425 of 2024 for the offences punishable under Sections 147, 148, 149, 341, 307, 323 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per allegation, on 01.06.2024 at about 7:30 P.M. the informant was going to village to meet with a party worker and near Gopalpur Math, about 35 people were sitting and while his vehicle was passing away from there, they made firing upon him. Thereafter, miscreants started pelting stone and bricks and when people gathered from Teneri village, they started assaulting them. It is further alleged that the FIR named accused persons including the petitioner and other 35-40 persons were armed with rifle, country made pistol, iron rod etc.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the petitioner has been

Patna High Court CR. MISC. No.52059 of 2024(2) dt.31-07-2024 2/2 made accused in the aforesaid case during Lok Sabha election 2024. He has also submitted that the petitioner is a voter. The dispute arose between two political parties and this false case was lodged by the informant against the petitioner and others, due to political rivalry. He has next submitted that the petitioner is a person of clean antecedent and is under custody since 01.06.2024.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned ACJM, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 425 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
