The petitioner is languishing in custody since 05.11.2014 in a case registered for offences punishable under Sections 366A/34 of the Indian Penal Code.

Prosecution case on the basis of written complaint by one Sanjay Pawan is that his daughter Puja Kumari @ Akriti Kumari, student of IX Class, left the house at 9.00 A.M. for school on 08.01.2014 but did not return. Thereafter, the family of the informant started to search her. The informant is posted at West Bengal in Village- Chambha, District- Vaishnav Nagar. During the course of the search, it transpired that Chanki Paswan, the petitioner aged about 22 years abducted the daughter of the informant after alluring for illegal work and she has been kept in the house of maternal uncle namely, Rajgiri Paswan, VillageChargoriya. Thereafter, informant and other people rushed there

Patna High Court Cr.Misc. No.33658 of 2015 (2) dt.19-08-2015 2/2 on 14.01.2014 but one day before accused Chanki Paswan had gone away. The father of he petitioner assured to hand over the daughter of the informant and later on he is also absconding. Chanki Paswan has relation with one of his villager-Kapil Paswan, where petitioner used to come. Bebal Kumari, daughter of Kapil Paswan has also hand in the present case, who used to manage Chanki Pawan talking on mobile to Puja Kumari. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and has been falsely implicated in the aforesaid case. He has brought to the notice that both the informant's daughter Puja Kumari and the petitioner Chanki Paswan were having love affair and being a major, marriage has also been solemnized between the two, as is evident from Annexure-3.

In view of the facts and circumstances, let the petitioner, namely, Chanki Paswan, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Rohtas at Sasaram in connection with Nokha P.S.Case No. 9/2014.
